When both spouses agree that their marriage has irretrievably broken down and want to end it amicably, mutual consent divorce is the most humane and efficient legal route available in India. What is Mutual Consent Divorce?
A mutual consent divorce, under Section 13-B HMA, allows a husband and wife to jointly petition a Family Court for dissolution of their marriage โ without assigning blame to either party. Both must agree on:
- That they have been living separately for at least one year
- The amount of permanent alimony / maintenance (if any)
- Custody, visitation, and maintenance of children (if applicable)
- Division of matrimonial property (if any)
There is no need to allege cruelty, adultery, or any other matrimonial offence.
The Two-Motion Process
First Motion (Petition)
Both spouses file a joint petition before the Family Court in the jurisdiction where they last lived together. The court records their statements on oath and admits the petition. A 6-month waiting period ("cooling off period") then begins.
Cooling Off Period
The law mandates a 6-month gap between the first and second motions to give the couple time to reconcile. However, the Supreme Court in Amardeep Singh v. Harveen Kaur (2017) held that courts can waive this period if: (1) all terms are settled, (2) the marriage is irretrievably broken, and (3) there is no possibility of reconciliation. Waiver is increasingly common when parties have been separated for a significant period.
Second Motion (Decree)
Within 18 months of the first motion (not before 6 months unless waived), both parties must file a second motion confirming their desire for divorce. The court hears them again and, if satisfied, passes the decree of divorce.
