What is a Title Search Report and Why Banks Require It

Before any bank disburses a home loan or mortgage-backed loan, it requires a Title Search Report (also called a Title Certificate) prepared by its panel advocate. This document is one of the most important legal instruments in property transactions — and yet most buyers know very little about it.

What is a Title Search Report?

A Title Search Report is a formal legal document prepared by an advocate after examining the registered documents relating to a property in the Sub-Registrar's office and other relevant government offices. It traces the complete chain of ownership of the property — typically for the past 30 years — and certifies whether the title is clear and marketable.

What Does a 30-Year Title Search Cover?

  • Chain of ownership — Who owned the property and when; all sale deeds, gift deeds, inheritance documents
  • Encumbrances — Existing mortgages, loans, or charges registered against the property
  • Pending litigation — Any suits, disputes, or attachments filed against the property
  • Government dues — Unpaid property tax, society dues, or other statutory charges
  • Development restrictions — Floor Space Index (FSI) compliance, zoning rules, reservations
  • Commencement Certificate, Occupation Certificate — For buildings, verifying that construction was lawfully done

Why Do Banks Require It?

Banks take the property as security (equitable mortgage) for the loan. If the borrower defaults, the bank needs to be able to recover the loan by selling the property. A property with a defective title cannot be easily sold — which means the bank's security is worthless. The title search report gives the bank legal assurance that the property is free of encumbrances and has a clear, uninterrupted chain of ownership.

What Defects Can a Title Search Reveal?

  • Missing or broken chain of title — gaps in ownership history
  • Undisclosed prior mortgages or loans against the property
  • Pending court cases or attachments
  • Property held by a deceased person without proper succession documents
  • Violation of development control rules
  • Dispute about partition among co-owners
  • Absence of valid Occupation Certificate
